Official Sweepstakes Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS SWEEPSTAKES IS VOID IN PUERTO RICO, RHODE ISLAND, U.S. TERRITORIES AND POSSESSIONS AND WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKE IS OPEN ONLY TO U.S. RESIDENTS 18 YEARS OF AGE AND OLDER AT THE TIME OF ENTRY. INTERNET ACCESS IS REQUIRED.
- HOW TO ENTER: You may enter the C6472 EVM Sweepstakes (this "Sweepstakes") by going to www.myti.com beginning on or about 12:01 am EST on October 26, 2009 and before
January 30, 2010 at 11:59 pm EST (the "Promotional Period"), and then following the online instructions to complete the online entry form. In the event of a dispute regarding the identity of the person submitting an online entry form, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected entrant may be required to provide Sponsor (as defined below) with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry and/or that he/she meets the territorial and age requirements set forth above. Limit one entry per person. Sponsor reserves the right, in its sole discretion, to disqualify anyone found with more than one entry or otherwise tampering with this Sweepstake.
Sponsor will be collecting personal data about entrants (including, without limitation, e-mail addresses) when such entrants enter the Sweepstakes. By participating in the Sweepstakes, entrants hereby agree to all personal information uses and disclaimers as explained in the Sponsor’s Website Privacy Policy, which can be found at Privacy Policy. Participation in the Sweepstakes further constitutes entrant's full and unconditional agreement to and acceptance of these Official Sweepstakes Rules and Privacy Policy and willingness to be contacted by telephone and/or email.
(4) Four Grand prizes (each a "Grand Prize") will be awarded from among all eligible entries received between the Promotional Period. The Grand Prize consists of a Texas Instruments C6472 EVM Evaluation Module (average retail value ("ARV") $349USD). A winner may not substitute a Grand Prize for its cash equivalent. Sponsor reserves the right to substitute a Grand Prize with any article or service of similar or greater value at its sole discretion. Grand Prize may not be assigned or transferred. Any applicable taxes on the Grand Prizes are solely the responsibility of the winner.
The total ARV of all prizes available to be won in this Sweepstakes is $1396USD.
All Grande Prizes are awarded, AS IS, and WITHOUT ANY WARRANTY OF ANY KIND, express or implied (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF ANY THIRD PARTY INTELLECTUAL PROPERTY RIGHT). THE USE OF ANY GRAND PRIZE IS AT THE WINNER’S OWN RISK. SPONSOR ASSUMES NO LIABLITY FOR THE WINNER’S USE OF THE GRAND PRIZES.
- ELIGIBILITY: To enter this Sweepstakes you must be a lawful permanent resident of the United States 18 years of age or older at the time of entry. The Sweepstakes is void in Puerto Rico, Rhode Island, U.S. territories and possessions and where restricted or prohibited by law. The Sweepstakes, and any website pages relating thereto, is intended for viewing only within the United States. You are not authorized to participate in the Sweepstakes if you are not located within the United States. The Sponsor, its promotional and advertising agencies, their respective parent company, subsidiaries, officers, directors, employees or agents (collectively, the "Sweepstakes Entities") and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters, regardless of where they reside) and members of their households (whether related or not) are ineligible to participate in this Sweepstakes.
- DRAWING: The Grand Prize winners will be selected in a random drawing from among all eligible entries received by Brandmovers, Inc., an independent agency ("Brandmovers"). Odds of winning depend on the number of eligible entries received. Drawing and awarding of the Grand Prizes will be conducted by an officer of Brandmovers whose decision will be final and binding in all respects. The Grand Prize winners will be selected on or around February 4, 2010. and the Grand Prize winners will be notified within thirty (30) days after the drawing by telephone, e-mail or mail. The Grand Prize winners may be required to sign, notarize and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited by law) and provide any additional information, that may be required by Sponsors and Brandmovers. Except where prohibited by law, the Grand Prize winners must return all such required documents within twenty-one (21) days following attempted notification or prize may be forfeited. Return of any prize/prize notification as undeliverable, or inability of Sponsors and Administrators to contact a potential winner may result in disqualification and selection of an alternate winner by random drawing.
- CERTAIN ADDITIONAL CONDITIONS:
- Entrants assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to Sponsor.
- Sponsor reserves the right, in its sole discretion, without prior notice and at any time, to cancel, terminate or suspend this Sweepstakes should virus, bugs, tampering, fraud, technical failures, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, integrity, fairness or proper conduct of this Sweepstakes. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if applicable) the action taken by Sponsor.
- At its sole discretion, Sponsor may disqualify any person whom it considers to have intentionally violated these Official Sweepstakes Rules or any element of this Sweepstakes or tampered with the entry process.
- By participating, entrants agree to be bound by the Official Sweepstakes Rules and the decisions of Sponsor and to waive any right to claim ambiguity in these Official Sweepstakes Rules.
- The Grand Prizes are awarded upon the condition that the Sweepstakes Entities shall have no liability whatsoever and shall be released, discharged, indemnified, and held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, or participation in this Sweepstakes or participation in or travel to any Sweepstakes-related activities and to sign any documents requested by Sponsor to evidence this release. Entrants hereby release and hold harmless the Sponsor from any and all claims, demands, losses or liabilities arising out of this Sweepstakes or the Grand Prize awarded hereunder. Sponsor assumes no liability or responsibility for damages, losses or injury resulting from this Sweepstakes or acceptance or use of the Grand Prizes.
- The Sweepstakes Entities are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled, or delayed computer transmissions, unauthorized access to, or alteration of entries, whether caused by Sponsor, users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof, which may occur and/or which may damage a user's system, hardware or software or limit a participant's ability to participate in the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CIVIL LAW. SHOULD AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
- By entering, the entrants grant to Sponsor the right use and publish his/her name, address, city, state, online or in print, or any other media, in connection with the Sweepstake. Except where prohibited by law, a winner’s acceptance of a Grand Prize constitutes permission for Sponsor and Brandmovers to use such winner’s name, address (city and state only), statements, photograph, voicetape and/or any likeness for any advertising/promotional or publicity purposes, without further compensation, consideration, review or consent.
- Sponsor reserves the right to disqualify any Grand Prize winner who does not pass the relevant US export control screening. Qualified Grand Prize winners agree to abide by the Sponsor's export control procedures as per the US export control laws and regulations on civil end use and/or end-users from designated countries such as China, Vietnam, Russia and/or any designated nations not otherwise indicated herein, under the US Export Administration Regulations.
- TAXES: All federal, state, and other tax liabilities (including but not limited to sales and use taxes, excise taxes, income and withholding taxes and like amounts) in connection with the Grand Prizes, acceptance or use of the Grand Prizes arising from this Sweepstakes, as well as applicable shipping fees related to the Grand Prizes are the sole responsibility of the winner.

- APPLICABLE LAW: These Official Sweepstake Rules are governed by the laws of the State of Georgia without giving effect to conflicts of law rules.
